By downloading, installing, or using Ares Dev Tools (the “App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the App.
1. No Warranty & Limitation of Liability
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. ARES LABS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ARES LABS BE LIABLE FOR PERSONAL INJURY, OR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APP, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF ARES LABS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
YOU AGREE THAT YOUR USE OF THE APP IS AT YOUR SOLE RISK, AND YOU ASSUME FULL RESPONSIBILITY FOR SECURING, BACKING UP, AND MANAGING ANY DATA YOU ENTER OR STORE WITHIN THE APP.
2. Ethical & Responsible Use
You agree to use the App only for lawful and authorized purposes. You agree not to:
• Violate any applicable federal, state, local, or international law or regulation.
• Exploit, harm, or attempt to exploit or harm minors in any way.
• Engage in unauthorized penetration testing, security breaches, or attempts to access systems, APIs, or data you are not permitted to access.
• Use the App for unsolicited advertising, spam, or promotional activities.
• Impersonate Ares Labs, its employees, or any other person or entity.
• Engage in conduct that interferes with or restricts others’ use of the App, or that harms Ares Labs, its reputation, or its users.
You are solely responsible for ensuring your use complies with applicable laws and third-party terms.
3. Intellectual Property
The App, including all code, design, interfaces, features, text, graphics, logos, trademarks, and related intellectual property, is and will remain the exclusive property of Ares Labs, LLC and its licensors. These Terms do not grant you ownership of, or rights to, the App or any associated intellectual property.
You may not copy, modify, reverse engineer, decompile, disassemble, translate, redistribute, or create derivative works based on the App except where such restrictions are prohibited by law.
4. Subscriptions & Payments
The App may offer paid features or subscriptions. All pricing, billing, payment processing, renewals, cancellations, and refunds are managed solely through the Apple App Store.
By purchasing a subscription, you agree to the applicable Apple Media Services Terms and Conditions, which govern:
• subscription terms and renewal periods
• how and when your Apple account is charged
• how to cancel or modify a subscription
• eligibility for refunds
Ares Labs does not collect or store payment information and is not responsible for billing issues, refund decisions, or subscription management. Please refer to your Apple account settings or Apple Support for assistance.
5. Offline Use & Local Device Data
The App operates fully offline. Ares Labs does not collect, access, store, transmit, or process personal data or usage information.
Any information you enter into the App—including notes, configurations, credentials, or API keys—is stored only on your device and remains solely your responsibility. You acknowledge and agree that:
• You control and manage your own data.
• You must secure your device and stored information.
• Ares Labs is not responsible for lost, corrupted, or compromised data.
• Data may be deleted if the App or device is removed, reset, or damaged.
6. Third-Party APIs, Credentials & Integrations
The App may allow you to store credentials or interact with third-party APIs or services you choose. Ares Labs does not provide, endorse, operate, or control these services.
You are solely responsible for:
• ensuring you have authorization to access third-party systems
• adhering to third-party terms, conditions, and rate limits
• protecting stored API keys, passwords, or authentication tokens
• all requests, actions, or consequences initiated through the App
Ares Labs is not liable for misuse, unauthorized access, data exposure, billing charges, or damages resulting from third-party service interaction.
7. Termination
Ares Labs may suspend or terminate access to the App if we reasonably believe you have violated these Terms. You may stop using the App at any time by deleting it from your device.
Sections relating to intellectual property, warranty disclaimers, liability limitations, governing law, and enforcement survive termination.
8. Changes to the App or Terms
We may modify, update, or discontinue the App or these Terms at any time. Updated Terms become effective when posted. Continued use of the App constitutes acceptance of the revised Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in state or federal courts located in Orange County, California.
10. App Store Terms Apply
These Terms supplement, and do not replace, the Apple Media Services Terms and Conditions and the Apple Standard End User License Agreement (EULA). If a conflict exists, Apple’s terms control.
